1. AGREEMENT TO OUR LEGAL TERMS

We are 2FUNDED LIMITED (“Company,” “we,” “us,” or “our”), a company registered in Hong Kong S.A.R, with a principal office at:
Unit 2A, 17/F, Glenealy Tower, No.1 Glenealy, Central, Hong Kong S.A.R.

We operate https://twofunded.com (the “Site”), offering proprietary trading evaluation programs (“Services”).

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, discontinue use of the Services immediately.

1.1 Updates to These Terms

We may modify or update these Terms at any time. Changes take effect upon posting on the Site or direct notification to you. Continued use of the Services constitutes acceptance of updated Terms.

1.2 Eligibility & Age Requirement

You must be 18 years or older to access or use the Services.

1.3 Contract Formation & Non-Refund Clause

By purchasing any evaluation program, you enter into a binding contract for the delivery of a non-refundable digital simulation service.

All fees are strictly non-refundable under any circumstances, including but not limited to:

• evaluation failure

• rule violations

• account termination

• user error

• technical issues

• voluntary cancellation
  
  

Evaluation purchases are final and non-refundable digital services.

2. OUR SERVICES

2Funded provides simulated trading evaluations assessing trader performance, discipline, and risk management. These evaluations determine eligibility for simulated funded accounts.

All 2Funded accounts operate in a demo environment. No real capital is traded at any stage. Payouts, where applicable, are performance-based rewards, not profits from live markets.

Users are responsible for ensuring they comply with local laws in their jurisdiction.

3. INTELLECTUAL PROPERTY RIGHTS & DATA USAGE

All content on the Site is owned or licensed by 2Funded and protected under applicable intellectual property laws.

You receive a limited, non-transferable, revocable license to use the Services solely for personal, non-commercial participation in evaluation programs.

3.1 Data Usage & Analytics Rights

By using the Services, you grant 2Funded a perpetual, royalty-free license to store, analyze, and utilize all simulated trading data for:

• internal analytics

• performance evaluation

• research

• product improvement

• 
  

Data may be shared within the 2Funded corporate group in anonymized or aggregated form.

4. USER REPRESENTATIONS

You represent and warrant that:

• All information provided is accurate and current

• You are legally capable of entering into binding contracts

• You will comply with all rules of the Services

• You will not use the Services unlawfully

• You understand all accounts are demo accounts, not live trading environments
  
  

5. EVALUATION RULES & FAILURE CONDITIONS

Evaluation criteria, drawdowns, risk limits, minimum trading days, and program-specific rules displayed in the user dashboard form an integral part of these Terms.

Any rule breach results in:

• automatic failure of the evaluation

• immediate termination of the account

• no refund
  
  

Dashboard rules always supersede any written descriptions.

6. USER REGISTRATION & ACCOUNT MANAGEMENT

You must safeguard your login credentials and are responsible for all activity within your account.

6.1 Account Suspension, Modification & Termination Rights

2Funded may modify, suspend, or terminate accounts at its discretion without prior notice for:

• suspected rule violations

• abnormal or manipulative trading

• technical manipulation

• system abuse

• provision of false information

• reputational risk
  
  

2Funded may also nullify trades, reset accounts, restrict access, or adjust leverage.
No refunds or compensation will be given.

6.2 Inactive Accounts

Evaluation accounts with no executed trades for 30 consecutive days may be paused or terminated without refund.

7. REPUTATION & CONDUCT POLICY

Users must not engage in:

• misleading public statements

• defamatory or false claims

• communications that harm 2Funded’s reputation
  
  

2Funded may take legal or administrative action against violations.

8. DEMO ENVIRONMENT DISCLAIMER & FORCE MAJEURE

8.1 Demo Environment Disclaimer

All trading occurs in a demo environment with simulated prices and conditions.
No live funds are traded or risked.

Payouts are performance-based rewards, not market profits.

8.2 As-Is Service Disclaimer & Force Majeure

All Services are provided on an “as-is” and “as-available” basis.
2Funded does not warrant:

• uninterrupted access

• pricing accuracy

• platform stability

• error-free performance

2Funded is not liable for interruptions caused by:

• third-party providers

• outages

• data loss

• force majeure events

8.3 Payout Review & Withholding Rights

2Funded may withhold payouts or suspend funded accounts if suspicious activity is detected, if rule violations are under review, or if additional verification is required.

Payouts may be paused or denied if the user is suspected of engaging in prohibited trading practices, system manipulation, or any activity that poses financial or reputational risk to 2Funded.

9. PROHIBITED TRADING ACTIVITIES & SYSTEM ABUSE

The following are strictly prohibited and result in immediate termination and forfeiture of fees:

• Latency arbitrage or exploiting delayed data

• Use of manipulated or external price feeds

• Copy-trading, mirroring, or coordinated trading

• Hedging between two or more evaluation/funded accounts

• High-frequency bots or latency exploitation

• Restricted-window news trading

• Any non-market-conforming or harmful activity
  
  
  

2Funded reserves sole authority to determine prohibited behavior.

10. INDEMNIFICATION

You agree to indemnify and hold 2Funded harmless from any claims, losses, damages, costs, or expenses arising from:

• Your breach of these Terms

• Misuse of the Services

• Public statements causing reputational harm

• Legal actions initiated due to your conduct
  
  

11. LIMITATION OF LIABILITY

2Funded is not liable for indirect, incidental, or consequential damages.
Maximum liability is limited to the total fees paid by you in the last 12 months.

12. GOVERNING LAW, ARBITRATION & CLASS ACTION WAIVER

These Terms are governed by Hong Kong law.

All disputes shall be resolved by arbitration seated in Hong Kong, in English.

12.1 Class Action Waiver

You waive the right to participate in:

• class actions

• collective lawsuits

• joint proceedings
  
  

All claims must be filed individually.

13. MISCELLANEOUS & PROGRAM UPDATES

2Funded may update program rules, evaluation parameters, payout conditions, and operational elements at any time.

Changes take immediate effect and apply to new and ongoing evaluations.

Continued use of Services constitutes acceptance of revised rules.

2Funded may suspend or modify Services for operational or maintenance reasons.

14. PAYMENT PROCESSING DISCLOSURE

Payment processing for certain transactions may be provided by Odeonpay ALE S.R.L (“Paysagi”). All payments, or payments for specific parts or regions, are processed by Odeonpay ALE S.R.L (“Paysagi”), registration number CUI 43293516, located at Bucureşti Sectorul 3, Bulevardul UNIRII, Nr. 61, Bl. F3, Scara 4, Etaj 2, Ap. 208, Romania, acting as the Merchant of Record (MOR).

These payments are subject to Paysagi’s Terms of Use, which can be found at:

Customers will be presented with these terms during the payment process.

15. CHARGEBACK & PAYMENT DISPUTE CLAUSE

Initiating a chargeback or payment dispute results in:

• Immediate termination of all accounts

• Permanent ban from all future 2Funded services

• Blacklisting

• Sharing of chargeback-related data with payment processors and partners
